I don't know who owned the truck but it is possible it has nothing to do with Network Rail.
According to Supt Andy Ball of the British Transport Police "the tipper truck was delivering ballast trackside"
A Network Rail spokeswoman also said that they had a representative on site at the time of the accident and that they had tried to warn the train driver by waving a handlamp.
