Rail worker arrested over crash (BBC News)
 
A Network Rail employee is arrested in connection with the train crash in Cumbria in which an elderly woman died.

Are rite I thought that it was a collective failing and no one single person was resposible. If this goverment had introduced a coprorate manslaghter law in then the top bosses could have had their collers felt.:mad:

What can a driver at the controls do when the train is off the tracks other than hang onto something. No steering wheel to guide the train with and the brakes will not work very well with the wheels on the rails.

yeah thats bilge.....i bet even the driver has said so...

as for responsibility, I imagine that the Prosecution will be asserting that the missing bits were wilfully and deliberatley left off....this is the only case I can think of where simply the guy with the spanner would be solely responsible. Doesnt happen? Read Adrian Vaughans book on Train Crashes for at least two examples of rail staff delberatley causing an accident! Proving it is very difficult though...

Its total speculation on my part, but there are many cases of people deliberatly flouting safety rules for many reasons. Perhaps to do the their job more easlily, or more quickly, or they are too lazy to do the job properly.
(And I have to be honest and admit I have done all of these myself in the past.)

So if this worker had deliberalty removing switch tie-rod bolts, for any of the any of the above reasons then he would be personally responsible.
